Beach Access stairs may NOT extend over the new berm. Access stairs must be no closer than 10 feet of the high tide line or no further oceanward than the toe of the existing dune (not the newly placed berm).
Simplified our justification for limiting beach access walkways a distance no further oceanward than the toe of the existing frontal dune (not new berm). I’m sure as more of these areas are pushed property owners are going to be contacting us all about extension request and there is no mechanism in our Rules that would allow for these extensions. Until the new beach berm obtains characteristics of a “frontal dune”, they will need to stop their walkways short (landward) of the pushed berm and walk over it by foot.
